ORCHESTRA LONDON CANADA INC FILES FOR VOLUNTARY BANKRUPTCY
London, Ontario – The #WePlayOn Musicians formerly of Orchestra London, wish to inform the community that Orchestra London Canada Inc.(OLC) has filed for voluntary bankruptcy. The musicians have retained a bankruptcy trustee, after consultation with the Board of OLC. The purpose of this action is to enable the musicians to continue with their commitment to bringing live music to the community. Voluntary bankruptcy is necessary for the musicians to realize a new identity and form new partnerships within the London community.
As eligible workers under the Wage Earner Protection Program (WEPP), the musicians are able to collect WEPP if OLC declares bankruptcy by May 22, 2015.
Q: What is WEPP?
A: The Wage Earner Protection Program provides guaranteed and timely payment of wages, vacation, severance and termination pay that are owed to eligible workers, up to an amount equalling four weeks of maximum insurable earnings under the Employment Insurance Act. Q: Are the musicians’ wages going to be retroactively paid after this bankruptcy?
A: No. The musicians, like any other terminated employees, are eligible to collect WEPP within the statutory six-month period.
Q: Are any other employees of the former OLC eligible for WEPP?
A: All terminated employees are eligible to collect WEPP within the statutory six-month period.
Q: Have the musicians forced the Board of OLC into bankruptcy?
A: No. The Board of OLC fully endorsed the musicians’ assistance into voluntary bankruptcy and the musicians consulted with the Board of OLC prior to the bankruptcy filing.
Q: Why are the musicians financing this and not the Board of OLC?
A: OLC does not have sufficient funds or assets available to fund this voluntary bankruptcy.
Q: How are the musicians able to finance this?
A: The musicians are financing the bankruptcy themselves and have secured a loan specifically for this purpose.
